How Does Spousal Maintenance Work In Wisconsin?

In general, alimony, or “spousal maintenance,” is based on each couple’s unique circumstances, including such factors as the length of the marriage, each party’s earning capacity (based on their age, health, prior work history and educational level), and the difference between each party’s income and resources.

Typically, marriages that have lasted less than 10 years do not result in an order of spousal maintenance. Marriages that have lasted between 10 and 20 years tend to result in alimony orders that last half the length of the marriage, while marriages that lasted 20 years or longer can result in indefinite orders for spousal maintenance – but those are not guaranteed results.

How Is Alimony Determined In A Military Divorce?

In general, the same factors are considered when awarding spousal maintenance in military divorces, but the Uniformed Services Former Spouses’ Protection Act (USFSPA) limits the amount of alimony a former spouse may receive to 50% of the servicemember’s disposable income.
